Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Find Your Next Catch, LLC ("FYNC," "we," "us," or "our"), governing your access to and use of the website at findyournextcatch.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Description of Service

Find Your Next Catch is an online platform that aggregates and displays sportfishing charter trip listings from landings across Southern California. Users can browse upcoming trips, compare vessels and pricing, and sign up for trip alerts. FYNC is an informational aggregator only — we do not sell tickets, process bookings, or act as an agent for any charter operator or landing.

Eligibility

You must be at least 18 years of age to use the Site. By using the Site, you represent and warrant that you meet this requirement.

Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local law or regulation
• Scrape, crawl, or otherwise extract data from the Site without our prior written consent
• Attempt to gain unauthorized access to any portion of the Site or its related systems
• Use the Site to transmit unsolicited commercial communications
• Interfere with or disrupt the integrity or performance of the Site
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or other malicious code

Third-Party Websites and Content

The Site contains links to third-party websites, including charter landing and booking pages, that are not owned or controlled by FYNC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party website.

Trip listings, availability, pricing, and vessel information displayed on the Site are sourced from third-party operators and landing websites. FYNC does not guarantee the accuracy, completeness, or timeliness of any such information. Always verify trip details directly with the charter operator or landing before making any booking decisions.

Intellectual Property

The Site and its original content, features, and functionality — including text, graphics, logos, and software — are and will remain the exclusive property of Find Your Next Catch, LLC and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or otherwise exploit any content from the Site without our express prior written permission.

User Accounts and Trip Alerts

If you create an account or sign up for trip alerts, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at keith@findyournextcatch.com of any unauthorized use. We reserve the right to terminate or suspend your account at any time, for any reason, without notice.

Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FYNC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIND YOUR NEXT CATCH, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. IN NO EVENT SHALL FYNC'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless Find Your Next Catch, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Site.

Dispute Resolution

Informal Negotiations. Before initiating formal dispute resolution, you agree to first attempt to resolve any dispute informally by contacting us at keith@findyournextcatch.com. The parties agree to negotiate in good faith for thirty (30) days from the date the dispute is raised.

Binding Arbitration. If informal negotiations fail, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in the State of California. You waive your right to a jury trial and to participate in a class action lawsuit.

Governing Courts. If arbitration is inapplicable, any legal action shall be brought exclusively in the state or federal courts located in California.

Time Limitation. Any cause of action arising from these Terms must be commenced within one (1) year after the cause of action accrues.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page and notify registered users by email. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
